What is Right to Manage?

Right to Manage gives leaseholders the legal right to take over management of their building — without having to prove fault or mismanagement. We support RTM companies through every stage of the process and beyond

Right to Manage is a legal process introduced by the Commonhold and Leasehold Reform Act 2002. It gives leaseholders the right to take over management functions from the freeholder — regardless of whether management has been good, bad or indifferent. There is no need to prove mismanagement.

Once the Right to Manage has been acquired, a company set up by the leaseholders — the RTM company — takes control of the building's management. That includes the budget, what works get done and, crucially, who manages the building day to day.

It is one of the most powerful tools available to leaseholders who want more control, more transparency and a better standard of management.

Does your building qualify?

Most leasehold buildings are eligible

To qualify for Right to Manage your building must:

  • Be a self-contained building or part of a building
  • Contain at least two flats
  • Have at least two thirds of the flats held on long leases
  • Have at least 50% of leaseholders participating in the RTM application

Commercial premises can be included in the building, provided they make up no more than 25% of the total floor area. Most standard leasehold apartment buildings qualify — if you're unsure, we're happy to assess your building as part of a free consultation.

How it works

The RTM process, step by step

The process begins

We can start the Right to Manage process with no upfront charges — if you agree to appoint ALLRES as your managing agent at the end of the process. No collecting money from neighbours, no legal fees to find.

Gather leaseholder support

At least 50% of flat owners in the building need to participate. We'll help identify leaseholders and support you in gathering the signatures required.

Notices served

We serve the formal Claim Notice on the freeholder and all leaseholders in the building — handling the legal paperwork on your behalf.

Freeholder response

The freeholder has one month to dispute the claim. If they don't dispute, they have three months to hand over management. If they do dispute, we take it through the tribunal process on your behalf.

Your RTM company takes control

Your RTM company now has full control of the building — including the budget, what works get done and who manages the building day to day. That's where ALLRES comes in.
